Whalebone internal whistleblowing system

What is it?

Pursuant to Directive (EU) No. 2019/1937 of the European Parliament and of the Council and in accordance with Act No. 171/2023 Coll., on Whistleblower Protection (hereinafter also referred to as the "Act"), Whalebone, s.r.o. has established an internal whistleblowing system for its employees and persons who have performed or are performing work or other similar activities for the company within the meaning of the Act and for its suppliers or contractors to receive and deal with reports of a possible unlawful conduct.

Possible unlawful conduct that has the characteristics of a crime, has the characteristics of an offence for which a fine of over CZK 100,000 may be imposed, violates the Act or violates another legal regulation or a regulation of the European Union in the areas expressly listed in the Act.

Where to report?

Report of a possible unlawful conduct shall be done by email, in writing by mail to the Company's address, in person or by telephone to the facilitator:

Report of possible unlawful conduct can also be made through the Department of Justice's reporting form available on the website https://oznamovatel.justice.cz/chci-podat-oznameni/.  

What should the report contain?

The report shall contain the following information: name, surname and date of birth, or other information from which the identity of the reporting person can be deduced. This shall not apply if the identity of the reporting person is known to the facilitator. Do not choose an anonymous form of reporting; anonymous reporting persons are not protected from retaliation. The identity of the reporting person will not be disclosed to the person being investigated without his/her consent. Knowingly false reports may be subject to penalties under the Act.

How will the report be handled?

Every report is strictly confidential. In accordance with the Act, receipt of the report is acknowledged within 7 days. In the event that it is not a report under the Act, the facilitator shall notify the reporting person. The report is normally dealt with within 30 days of its submission.

Instructions on the processing of personal data:

Within the framework of the internal reporting system established pursuant to Act No. 171/2023 Coll., and the subsequent processing of the reports received, personal data of the reporting person (if provided) and/or data of third parties are processed.
